Regulation of Employment of Workers

Employment in Qatar is governed and regulated by a set of well-defined laws that are constituted in Qatar Labor Law no. 14 of year 2004. In the present article, we will be detailing some of the provisions showing under Part three of the Qatar Labor Law document, which is titled Regulation of the Employment of Workers

Provision to Safeguard Employment opportunities of Qatari Nationals

The Qatar Labor law includes provisions, which state explicitly that all Qatari nationals will be given priority in employment opportunities. Such provisions ensure that Qatari nationals are guaranteed with special preference for any kind of employment opportunities.

Provision to Record Employee Details

Article 19 of the Regulation of the Employment of Workers states that all employers should provide the Ministry of Labor with detailed schedule regarding all their employees. The schedule provided should include the following information:

Name of Employee

Age

Gender

Nationalities

Job profile

Wages earned

Work permit details

 

Provision to Regulate Employment

In an attempt to regulate employment opportunities, Article 20 of Qatar Labor Law lays down a three-pronged approach for the labor department to practice. These include the following:

Collect information and conduct research on available job opportunities and resource requirement

Encourage all unemployed Qatari nationals or those seeking better employment opportunities to register with the Labor department. The registration process has to be completed by the applicants on their own by filling the registration form with their age, skill area, qualifications and previous experience, following which, applicants receive a certificate of registration.

Map the job requirement with the appropriate resource profile found as a result of the research conducted and nominate the best candidate for the job.

Provision to make Employee registration compulsory

In Article 21 of the Regulation of the Employment of Workers, there is a mandatory requirement for all Qatari Nationals to have a certificate of registration as per the above described process, prior to applying for jobs.

 

Provision to ensure open employment opportunity

Article 22 of Qatar Labor Law mandates that all employers with a resource requirement should notify the Ministry of Labor of the same with the following details:

Nature of vacancy available

Expected skills and qualifications of the prospective candidates

Remuneration committed

Date by when the position should be filled

All these details should be submitted to the Ministry of Labor in order to secure an appropriate match for the requirements within a month from the date of vacancy or formation of the job.

It is also required that all employers having received the appropriate resource that fulfils their requirement should return to the Ministry of Labor within 7 days from the date of employment the certificate of registration of the employee and a work statement that incudes the following details:

The nature of the Job

The wages allocated for the job

The date of commencement of the work

 

Provision for Work permits of Non-Qatari employees

Qatar labor law mandates that Non-Qatari nationals would require a valid work permit for obtaining employment opportunities in Qatar. The validity of the permit is usually limited to a maximum period of five years unless otherwise defined by the Ministry of Labor.
